MACON: On Tuesday, April 1, 2003, Kathy Johnson, 34, of Putnam County, Georgia, plead guilty to a superceding information for the felony offense of Misprision of a Felony in U.S. District Court before the Honorable Hugh Lawson. Ms Johnson was originally indicted as a co-defendant with Malachi York.On January 23, 2003, York pled guilty to one count of violating the Mann Act (transporting minors across state lines for immoral purposes) and one count of structuring monetary transactions. As part of the stipulated facts in his plea agreement, York admitted to transporting minors from New York to Georgia for the purpose of sexual abuse, including sexual intercourse and sodomy.
As part of the stipulated facts in her plea agreement, Johnson admitted that she knew that York transported minors in interstate commerce for unlawful sexual purposes. The offense of Misprision of a Felony carries a maximum sentence of three (3) years imprisonment, a $250,000 fine, or both. Johnson will be sentenced in about sixty (60) days following a Pre-sentence Investigation and Report. This case was investigated by the Macon office of the Federal Bureau of Investigation and the Putnam County Sheriff's Office. Assistant United States Attorney Richard S. Moultrie, Jr. is prosecuting the case for the Government.
